01Acceptance of terms

By accessing or using the Site, you confirm that you are at least 18 years old and able to enter into a binding agreement, and you accept these Terms and our Privacy Policy. We may update these Terms from time to time; the “Last updated” date above reflects the latest version, and your continued use constitutes acceptance.

02Our services

Pivt Media is a full-service social and content agency. Our work spans three areas:

• Content & Social Media — strategy, content, and community across platforms;
• Demand Generation — full-funnel paid media, SEO, and lifecycle marketing; and
• Web & Identity — brand identity, positioning, and conversion-focused websites.

The Site itself is provided for general information. Any paid engagement is governed by a separate written service agreement between you and Pivt Media, which controls in the event of any conflict with these Terms for that engagement.

03Client engagements

Where you engage Pivt Media for services, the following summary applies, as detailed in your signed agreement:

• Scope. We provide the services outlined in your selected package, which may include brand strategy, paid social management, web design, email marketing, and creative production, as agreed at kickoff.
• Term.The engagement runs for the initial term stated in your agreement and renews month-to-month thereafter. Either party may terminate with 30 days’ written notice.
• Fees. Fees are the retainer and any one-time onboarding amount shown in your agreement, billed securely via Stripe.
• Confidentiality. Both parties agree to protect confidential information shared during the engagement, including credentials, financials, and strategic plans.

04Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site or its systems;
• Interfere with or disrupt the Site, its security, or its infrastructure;
• Copy, scrape, or reproduce Site content except as permitted below or with our written consent.

05Intellectual property

The Site and its content — including text, graphics, logos, the Pivt Media name and marks, images, and design — are owned by or licensed to Pivt Media and are protected by intellectual-property laws. Client and campaign imagery shown in our work is displayed with permission and remains the property of its respective owners. You may not use our marks or content without our prior written permission.

06Submissions

Any information you submit through the Site’s forms is handled in accordance with our Privacy Policy. Please do not send confidential or proprietary ideas you expect us to keep secret through public forms; unsolicited submissions are not treated as confidential.

07Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

08Limitation of liability

To the fullest extent permitted by law, Pivt Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Liability arising from a paid engagement is governed by the applicable service agreement.

09Indemnification

You agree to indemnify and hold harmless Pivt Media and its team from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.

10Third-party links

The Site may contain links to third-party websites and platforms. We are not responsible for their content, policies, or practices, and provide such links for convenience only.

11Governing law & disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Ohio, and you consent to their jurisdiction.
